Welcome to ShopWithMe! By accessing or using ShopWithMe, registering, or completing a payment on ShopWithMe, you agree to the following terms and conditions. Please read them carefully before engaging in any transactions or activities on ShopWithMe.
1. General Terms
1.1. Acceptance of Terms: By using ShopWithMe, you acknowledge that you have read, understood, and agree to comply with and be bound by these terms and conditions. If you do not agree, please do not use ShopWithMe.
1.2. Modifications: We reserve the right to update or modify these terms at any time. Changes will be effective immediately upon posting.
1.3. Eligibility: You must be at least 18 years old or have parental/guardian consent to use our platform.
2. ShopWithMe’s Role in Transactions
2.1. What is ShopWithMe: ShopWithMe is an AI-powered platform designed for virtual personal shoppers and content creators, enabling them to create listings and sell items during live shopping sessions hosted on third-party social media platforms such as Instagram, TikTok, Facebook, YouTube, and more.
2.2. Payment Responsibility: ShopWithMe is responsible for securely accepting payments from customers and transferring those funds - including the cost of purchased items, finder’s fees, and other applicable fees - to personal shoppers for the items listed on their page on ShopWithMe.
2.3. Payment Guarantee: ShopWithMe guarantees that all payments made by customers on ShopWithMe will be processed securely and transferred to the respective shopper after the purchase is completed.
2.4. Limited Responsibility: ShopWithMe’s role is limited to facilitating payments between customers and shoppers. We are not responsible for the actions of personal shoppers, including but not limited to:
- Shipping of items to customers.
- Mistakes with orders.
- Shipment delays or non-delivery.
- Issues with the quality of items.
2.5. Independent Interaction: Customers independently choose, follow, interact with, and trust personal shoppers on third-party platforms (such as Instagram, TikTok, Facebook, YouTube, etc.). The decision to engage, watch, and transact with a shopper is entirely at the customer’s discretion. ShopWithMe does not recommend or endorse any specific shopper or content creator.
2.6. No Liability for Shipping or Purchase Issues: Even if the purchase and payment are completed on ShopWithMe, we are not liable for any issues related to shipping, delivery, or product quality. The fact that we facilitate payments does not imply responsibility for these actions. Customers transact with the shopper at their own risk. ShopWithMe is not liable for delays, non-delivery, or the quality of items shipped or received.
2.7. Guarantees: ShopWithMe guarantees and provides purchase protection only when fulfillment (packing and shipping) is handled by ShopWithMe, and shoppers are paid only after items are received at our fulfillment center and shipped to customers by the ShopWithMe team.
3. Finder’s Fees and Convenience Fee
3.1. Finder’s Fees: Finder’s fees are set by ShopWithMe and are displayed at checkout.
3.2. Convenience Fee: ShopWithMe charges a convenience fee, retained by the platform to cover operational costs.
4. Shipping
4.1. Shipping fees shown at checkout are estimates based on dimensions and weight provided at the time of listing. ShopWithMe reserves the right to adjust shipping fees if significant differences arise between estimated and actual costs.
4.2. For items fulfilled by ShopWithMe, we provide 100% purchase protection, ensuring safe and secure handling of transactions and shipments.
4.3. ShopWithMe is not responsible for shipping items directly handled by shoppers. Customers should confirm shipment timelines and details with the shopper during or after live streams.
5. Non-Returnable and Non-Refundable Purchases
5.1. All purchases on ShopWithMe are final and non-refundable due to the nature of live shopping.
5.2. Customers should confirm product quality and details with the shopper during the live session.
6. Product Information
6.1. Product titles, descriptions, dimensions, size, color, brand, price, and other details are generated by AI and should be reviewed by both shoppers and customers before publishing listings or completing purchases.
6.2. If inaccuracies or discrepancies are identified, shoppers must correct them manually in the listing app, and customers should confirm details with the shopper during the live session before completing the purchase.
6.3. Discrepancies or inaccuracies in product information, such as descriptions or details, cannot serve as grounds for returns, refunds, or complaints. The item image is considered binding, and shoppers must ensure the item they ship matches the image shown on the customer’s order.
7. Security of Payment Methods
7.1. All payment methods on ShopWithMe are secure. We use trusted providers like Stripe, PayPal, Apple Pay, and Google Pay for payment processing.
7.2. Saved payment methods are stored securely by the payment providers, not by ShopWithMe.
8. Dispute Resolution and Fraud Prevention
8.1. ShopWithMe is not responsible for quality issues or disputes between shoppers and customers. Complaints should be addressed directly with the shopper.
8.2. If fraudulent activity is suspected, ShopWithMe reserves the right to investigate and limit access to the platform for any user.
